Wild at Heart Gift Card - Terms and Conditions

By accepting and using your gift card (the “Gift Card”) youare agreeing to these Terms and Conditions. Please read them carefully and keep a copy for your records.

The Gift Card is a prepaid Card that can be used forpurchases of merchandise from Wild at Heart Ministries, using the contact information on the back of the Gift Card. The Gift Card may not be used to make purchases from other merchants, toobtain cash from automated teller machines (ATMs) or for any other type ofpurchase or cash advance.

Gift Cards must be redeemed at www.ransomedheart.com toward the purchase of eligible products, to register and pay for eligible events, or to make a donation to Wild at Heart Ministries. Purchases are deducted from the Gift Card balance. Any unused balance will remain in the recipient's Gift Cardaccount. If an order exceeds the amount of the Gift Card, the balance must bepaid with a credit card or other available payment method. Wild at Heart may provide Gift Card purchasers with information about the redemption status of Gift Cards that they purchase.

Limitations.

· Gift Cards cannot be used to purchase other gift cards.

· Gift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. Unused Gift Card balances in a card account may not be transferred.

· If you attempt to process the Gift Card for more than the available balance, the transaction willbe declined. If your Gift Card balance is zero or becomes zero the Gift Card will be terminated.

· The Gift Card is not a credit card.

· The first time you use the Gift Card you will be presented with the card balance. On subsequent visits to www.ransomedheart.com, you can see your remaining Gift Card balance by logging into your profile.

· You may only use your Gift Card in the manner and for the purposes described in these Terms and Conditions.

· Your Gift Card may notbe used for illegal transactions or for any type of pre-authorized transactions such as recurring monthly payments, dues or fees.

· Please contact us directly for customer service issues, using the contact information on the back of your Gift Card.

Fraud. Wild at Heart Ministries will have the right to close customer accounts and bill alternative forms ofpayment if a fraudulently obtained Gift Card is redeemed and/or used to makepurchases on www.ransomedheart.com.

Limitation of Liability. Wild at Heart Ministries makes no warranties, express or implied, with respect to Gift Cards, including without limitation, any express or implied warranty of merchantability, or fitness for a particular purpose. In the event a Gift Card code is non-functional, your sole remedy, and our sole liability, shall be the replacement of the Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

General Terms. Gift Cards are issued by Wild at Heart Ministries. When you purchase, receive or redeem a Gift Card, you agree that the laws of the State of Colorado, without regard to principles of conflict of laws, will govern these Gift Card Terms and Conditions.

Expiration of Gift Cards. There is no expiration date for Gift Cards.

Your Gift Card. The Gift Card is offered to individuals over the age of 18 that lawfully enter into and form contracts under applicable law, and by using the Gift Card you representand warrant to us that you are such an individual. We, in our sole discretion, may refuse to issue a Gift Card for any reason.

Returns. We accept Gift Card returns up to 30 days after delivery for a full refund with the following provisions:

-The Gift Card must not be damaged in any way; we only accept Gift Cards that are in"new" condition.

-Refunds will be credited when we receive the Gift Card(s).

-Shipping charges will be deducted before processing a refund.

-Retreats and seminars do not qualify for refunds under this policy.

Disputes. You agree to make a good faith effort to settle all disputes about Gift Cardpurchases.

Lost and Stolen Cards. The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission to the purchaser, recipient or delivery to the carrier, whichever is applicable. We are not responsible if a Gift Card is lost, stolen, destroyed or used without your permission. Treat your Gift Card like cash, because lost or stolen Gift Cards will not be replaced.

Termination. The Gift Card shall remain the property of Wild at Heart Ministries. We may, atany time and without prior notice, cancel your Gift Card and have you return the Gift Card to us, and we will refund the balance remaining on the card. You may terminate your Gift Card by returning the Gift Card to us. Termination of the GiftCard will not affect prior transactions or obligations existing at the time oftermination.

Amendment. We may amend these Terms and Conditions at any time in our sole discretion byposting a revised copy on www.ransomedheart.com/giftcard at least 30 days prior to the effective date of any amendment that results in an increased fee or charge, an increase in your liability, a reduction in Gift Card services, or stricter transaction limitations.

Severability/No Waiver. If any provision of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Our failure to enforce the strict performance of any provision of these Terms and Conditions will not constitute a waiver of our right to subsequently enforce such provision or any other provision of these Terms and Conditions.

Arbitration. Any dispute, controversy or claim arising out of or relating to a Gift Card, these Terms and Conditions or the provision of services hereunder shall be settled by binding arbitration before a retired judge in accordance with the commercial arbitration rules of Colorado. The prevailing party shall be awarded their arbitrator and attorneys’ fees, costs and expenses to the maximum extent permissible. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. Either you or we may seek any interim or preliminary relief from a court of competent jurisdiction in El Paso County, Colorado necessary to protect the rights of property (yours, ours, or our agents’, suppliers’, or subcontractors’ rights) pending the completion of the arbitration.
